Court dismisses sex lawsuit by male CBS worker
SAN FRANCISCO (Reuters) - A split U.S. appeals court dismissed a lawsuit on Tuesday in which a male CBS TV station employee alleged sexual harassment by a female manager who offered him oral sex and "life-altering" intercourse.
The case involves Hugh Hardage, who worked as an advertising executive for Washington state's KSTW-TV, owned by Viacom Inc., starting in 1998. In a lawsuit, Hardage, who resigned in 2001, alleged that General Manager Kathy Sparks made unwelcome sexual advances on several occasions.
When Hardage complained to sales manager Patty Dean, he said she responded: "Why don't you just do it and get it over with? It may put her in a better mood." But Dean also set up an investigation of the alleged abuse.
A three-judge panel of the 9th Circuit Court of Appeals said even if the remark was unfortunate, CBS acted properly overall, and it affirmed a lower court dismissal of the suit.
"Dean's alleged comment to Hardage that 'Why don't you just do it and get it over with. It may put her in a better mood' is certainly troubling," Judge Clifford Wallace wrote. But "considering the 'overall picture,' CBS's response was both prompt and reasonable as a matter of law."
In a partial dissent, Judge Richard Paez said CBS did not properly investigate the alleged abuses.
"It is difficult to imagine how any reasonable juror could conclude that an employer who suggests that the complainant have sex with a harassing supervisor has acted reasonably to end the harassment," he wrote.

Delfino, changing the colour of a pickup isn always easy 'cause the plastic top of it round the pole-pieces is nicely attached. You should be able to get an Air Norton 7 in the same green though!

Hey Joe, nice seeing ya again...
it sure seems like Vancouver is the spot for recording music... why is that? Motley Crue has recorded there, Aerosmith, and I think even Metallica has, producer Bob Rock used to live there or still does, amoung other great producers. I know that much...
anyways, can't wait for the new material and the pending tour...

I sure hope so, I checked the Dimarzio website and they don't seem to have it in green on there...but fingers crossed there is an oddity out there.
If I get these pickups and have them installed this will be my main guitar for a good few years yet...
anywayz in other Delfino news, I've got 4 assignments to hand in in just over a month...so I might not be around here for a few weeks. I've got an assignment where I have to make a room in 3D, one where I have to make an assault level for Unreal tournament 2004, one where I have to make a movie poster and one where I have to do the game documentation for an already existing game.
I'll post pictures of my 3D room, my unreal level and my film poster when they're finished.
This truly is an awesome course, I'm loving every moment of it.

I know you get this all the time but thought I'd try. I've got a 12 (almost 13 year old son) who pretty much worships you and your music. As a fellow guitarist and one of my strongest influences, I've been working with him for about two years on his chops, scales, etc. - he's going to be great. I turned him onto your music about a year ago - he's all over it. His favorite song is "Just look up" - a great one to practice solos too for myself.
I'd love to find a way to get an autographed promo picture or poster of you that's for real - eBay is loaded with fakes. If there's a chance of something, I assume you can get my email from the webmaster for your site – it would be the greatest. If not, I certainly understand as I know my request must be one in a million.

One thing that really pisses me off...
All the fricking adults out there that say to uphold moral values. No cussing, do this, do that, dont put people down. But what do they do? Can you answer this? Can you? I have reveived more profanity from adults who say not to use such bad language than I have from some crackhead in the park! I HATE hypocrites! G'day, I just bought the new G3 and was amazed at what a remarkable show was put on. Petrucci oustanded me, I thought for sure his stuff was going to be alot of the shredding we hear in Dream Theatre solos. Vai was the amazing man he always was and Satch was incredible, although i do have to say that i was a little disappointed with Satch's set, Up in Flames is and amazing song but, personally, I think he could have gotten better songs than Searching and War. None the less, amazing concert and I hope the next one is a little closer to home next time.
