hey joe. i know this is really asking alot and i dont expect you to actually make this happen, not that i dont think ur a good guy its just asking alot. well with the economy and stuff my family has lost a lot of money and my dad is making a lot in his job ( he rights music for commercials) for christmas i really wanted a black js100. All i have is a fender squire and we cant spend that kind of money on a guitar right now so all i am getting for xmas is a foot pedal. its asking alot and you dont have to do this so dont think im a selfish begger that just wants free stuff, but i would be the happiest kid on earth if you could send me a black js100. i believe that when creating this account i entered my adress so it would be so so great if this could happen. i dont expect it so dont worry if this isnt possible. im not that desperate. i am a huge fan and love your work. thanks for your time joe

Just a suggestion.

I love Music Radar!!! Check out the photo caption under their picture of the Time Machine pedal:

There's been no confirmation yet as to whether the Time Machine will delay your playing long enough for Coldplay to plagiarise it...

Holy crap i know what I'm telling my g/f I'm buying myself for my birthday :X a Time Machine. It's very easy to convince her to let me buy a time machine...though I'm sure she'll be disappointed that it's only an effect pedal.

and thanks for that link austin haha

The Lawsuit.

I've got twenty-plus years of experience as a trial lawyer, and, in the space of the last eight years, I've been convinced that Joe's music and his guitar work are special in a way that only comes along a few times in a century.

While I don't practice copyright law, I know enough about trial practice that it wouldn't be difficult at all to try this case. I am also at home with the creative process, as I studied it failrly intensely while attempting to be a novelist in a former life.

I'll first observe that the snippet from youtube is very compelling evidence. I think Joe is right, and I think he'll win.

But what disturbs me is what I perceive to be the strongest defense I've seen from the Coldplay crowd: The "You Stole it First" defense. There was the snippet from a Cat Stevens song (listen to it at 3:22 forward http://uk.youtube.com/watch?v=uUXda-RTE_c) which apparently predates "If I Could Fly" by over thirty years; and if I were the lawyer representing Coldplay, you can bet I'd be playing that tune during the trial.

I'd like to hear from others more musically adept about the differences between the two; I'd also suggest that before anyone who might be a witness in the case post anything, to please consider that you will be stuck with your words.

I wish I could work on a case where you had great forums all over the world from which to draw your research/investigation.

Nick

Hello again everyone. Well, my day off came to an end early. I got called in to work to do a banquet function. On the good side, it was my college alum that I was serving. Now I have to be at work in the morning by six. Hey, there is a charity auction on Ebay and they are auctioning off Christmas ornaments signed by celebrities. One of the ornaments is signed by Joe. Check it out. I am about to place a bid on that. Well, time for bed and be back to work in the next few hours. Keep in touch everyone (and to those who I wrote to). LOL!

Hey Satchfans!!

Does anyone out there know if Epic is going to re release Flying in a Blue Dream next year??

I think it would be fantastic if they made it a deluxe edition like they did with surfing.

What do you think?

that Cat Stevens is quite a reach. Coldplay fans are grasping at this one. It was like one chord. That happens all the time in music. The Coldplay song just really rips off the entire song. Granted they put some bells and other instruments to it, but damn. It's pretty blatent. Joe, I hope you kick their ass.

I read the article where Joe said they probably just thinkk it's some little guitar player who will just go away. It would really be a shame if they win an award for this. It could be a Milli Vanilli in the making! LOL. Give back the award!

Do the Stu - You mentioned Buckethead playing with an ipod. Did he not have a band playing with him? I have heard he's in something like 6 active bands right now. Crazy. Did he play Jordan? I like that hsong.

"You stole it first!" won't really work as a defense for Coldplay. It doesn't matter if they think Joe ripped off Cat Stevens (a weak argument, in my opinion) or the one or two other bands with similar sounding songs. If those people thought he ripped them off, he would have been sued back in 2004. Coldplay doesn't own the rights to those songs...they can't make a case on the behalf of someone else.

Plus, you can't copyright a chord progression. I posted a video on here after Joe's YouTube Live thing of a comedian making fun of how common Pachelbel's Canon in D is (that's the non-Satch song Joe played with Funtwo). The comedian plays a bunch of other songs with similar chord progressions. It's fine for music to be the same in that way when there's a different feel/tempo/melody.

The Coldplay song has a melody that's at a minimum very similar to (if not directly lifted from...I haven't written it out) If I Could Fly. That's enough for a lawsuit. The fact that the Coldplay song has a nearly identical chord progression and almost exactly the same tempo makes the similarities in the melody even more obvious, and (in my mind) means a higher probability of plagiarism.

About the only argument using other music that I can see Coldplay making would be trying to say the aspects of that song (chord progression, melody, etc.) are extremely common in popular music and have been around for hundreds of years and should be considered in the public domain.

But if that were the case, the "Joe stole it first!" people would have more than one or two videos as evidence...and we'd have music scholars citing classical works that are similar to If I Could Fly.

Glitzy - sounds like you are working alot, you must be knackered - don't know how you can run. I am up again at 5.30am tomorrow trying to become a runner - if it wasn't for the ipod and Joe I would vomit.

Very soon my group of girlfriends and I are choosing a goal for next year - something like a run, half marathon, bush walk, triathlon, don't know yet. Some of the group do ocean swims.

To kick things off next Saturday we are having "Run to the Pub" which is a ripoff of a famous Melbourne event called "Run to the G" where thousands of people run a circuit ending at the MCG stadium.

We will be starting at our local shops, cycling over to the next village where one of our local bars is, then cycling or running back to one of the girls' homes where we finish in the pool to do laps with many glasses of wine. This is the official kickoff to the proper training for the goal next year.

Also re the cold - my failsafe remedy is to drink marsala, or take a plug of wasabe which clears the sinuses in nano-seconds :0)

roo - I like Chickenfoot as a name so add me to the list pls :0).

Cheesey - thanks for the link to the Time Machine vid - I have no idea about the technicals but I love his alien stuff!

GoldenGirl - how you doing? Still going to learn guitar?

GlitzMan: Well, it snowed the other week where I am, (North ish), but it's been raining again...doesn't do much for the stereotype does it? It's nice over here providing you get the right place with the right weather; we've been trying to get that with every holiday for a long time.... :) Everything's also on a much smaller scale over here, I remember when I visited the US in '06 and just thinking...wow...everything was so big!

i am a singer/guitarist and had to write to you via this post...i have been watching the news about your copywrite issue with coldplay...now i am not even a coldplay fan so lets get this out of the way from the start,i don't like there music! my issue with this case is....what if a singer/guitarist is writing a song...and in your situation has been accused of copying it! what if that artist has never been a fan of yours and has heard very little of your work...lets face it,you are well known...but not radio played like u2,coldplay,beatles,acdc...look the list goes on.the point i am making is i could write a song and then some big artist i am no fan of...accuses me of copying a song i may have never heard of! look at the example of british group...the verve.they had a huge hit with "bitter sweet symphony' and got accused by the stones that they copied a song of theres.the verve went to court saying they knew of the song, but never even thought of that song when writing it...and only when they were accused were they aware of it! a few years ago i was writing a song with my band...i had a basic melody and they helped me some parts..i put words to it and thought it was a great song...still do! anyway someone points out that it sounds a little like this particular group...and a certain song.i knew the group...a couple of there songs...but thats all and didn't own any cd's etc...my friend came back to me with this cd... a local band...it was never a hit single...or released as one...it was just an album filler track i had never heard of it! and to my amazement it sounded like my song! so it can happen....as i said i am not a cold play fan...i hate them...i do hear the similarities in these 2 songs...but when coldplay have had countless hit singles and albums and fill stadiums around the world etc...why they would want to pick a track of yours and deliberately steal your melody....look at the romantics...'thats what i like about you" and john melloncamps..."r.o.c.k in the usa" how alike are they???? so yes maybe it could happen...but i feel that these hug bands decide that to make it go away they pay out of court...instead of fighting it...how can you prove in court and recreate how you wrote a song.seems to me the easier thing to do...and if your in the middle of a world tour...it would be more convenient to pay out of court than cancel concerts.you are a great musician...sorry to waste your time...it just got me a little angry after a few other cases over the years etc...and i am not a coldplay fan...just a small fry singer guitarist.just because an artist has a cd released doesn't mean we have all heard every single track that artist has released.only maybe a few singles etc.
